The Ontario Land Tribunal (OLT) ruled that the Bruce Trail Conservancy (BTC) did not have to pay the Town a parkland levy as a condition of its severance application. The BTC sought to sever the property it purchased at 287199 10 Sideroad. The Town’s Committee of Adjustment, which rules on severance applications, included as a condition of the severance, that the BTC shall pay a parkland levy. A parkland levy is used by a municipality to fund parks or for other public recreational purposes. The BTC appealed the committee’s decision to the OLT. In its ruling the OLT stated, “The Tribunal is not convinced that severing a lot with an existing dwelling justifies the imposition of a Parkland Levy as it does not create a need for additional parkland or recreational services."
